“Vista capable” lawsuit seeks class-action statusThe status on whether to certify “Vista capable” suit as a nationwide class-action case is now in the hands of a US federal court after Microsoft filed its official opposition to the request of the plaintiffs for class-action status.

Last month, lawyers for the plaintiffs have formally requested a full nationwide class-action status for the Vista-Capable lawsuit against Microsoft.

As a background, a lawsuit filed against Microsoft in March for the alleged deceptive marketing practices by letting PC makers promotes computers as “Windows Vista Capable” despite the machines were not capable of running the “signature” features of Windows Vista.

The plaintiffs argue that “consumers were deceived by the ‘capable’ branding into believing that they could get the full benefits of Vista, including the Aero interface, on their machines, but that many of the key features Microsoft advertised in Vista remained out of reach,” Ars Technica writes.

However, Microsoft filed its official opposition to the requested class-action status and argued that it does not mislead or deceived the consumers.

“We feel as a company we went beyond what we’ve ever done to try to educate people so that they understood and could make the right purchase decision,” Linda Norman, a Microsoft associate general counsel told Seattlepi.

The company “conducted a very broad and unprecedented effort” to help PC makers, retailers and consumers “understand the hardware requirements to run the various flavors of the Windows Vista operating system,” Norman added.

“Microsoft claims that it was very clear that the ‘Windows Capable’ logo meant that the PC would run some version of Vista – not that it would run any version of the software,” Network World writes.

It’s interesting to see on whether the case be expanded into a nationwide class-action suit. However, the federal court has not set a date for the ruling on the class-action request.
