New Google filing presses for role in Vista’s desktop search caseGoogle remains undaunted in its of pursuit of Microsoft over Vista desktop search. Despite its setback last week when a federal judge pronounced that Google has no legal standing in a 2001 anti-trust agreement, Google has filed another “friend of the court” brief in a US District Court.

Google believes its voice should be heard. In its latest filing, the company argues that:

“As the developer of a major desktop search product and the company that brought the desktop search issue to the attention of the plaintiffs, Google has familiarity with the issues raised and is well positioned to provide information to the Court. Google worked with the plaintiffs for an extended period of time to ensure that Microsoft’s violation did not go unaddressed, and nothing in Google’s request for leave to participate as amicus curiae is inconsistent with the plaintiffs’ fundamental role in enforcing the Final Judgment, as confirmed by the fact that none of the plaintiffs opposes Google’s motion.”

Google has been claiming that Microsoft’s implementation of desktop search in Vista is unfair as it restricts competition among other desktop search products.

While Microsoft quickly agreed to make changes to Vista’s desktop search functionality and promised the update to be release early next year with Vista Service Pack 1, Google isn’t so convinced that the coming changes will address its concerns.

“The remedial measures appear to have been settled upon very quickly, and few details have been provided to Google, the public, and the Court,” Google complained in the brief.”

However, Google spokesman Adam Kovacevich clarified that the latest filing doesn’t mean that Google is looking for a means to further press its case.

In a phone interview, Kovacevich told seattlepi.com that “This latest filing was primarily a procedural matter, complying with the judge’s statement in court that Google needed to answer Microsoft’s response to its motion.”

Earlier, Microsoft argued that Google shouldn’t be granted to participate as “friend of the court.”
