'Windows Vista Capable' claim faces another legal challengeNvidia, maker of graphics card, may be facing a class-action lawsuit over the “Designed for Windows Vista” claim on its 8800 graphics card series which was release before Windows Vista was officially released.

The website nvidiaclassaction.info posted “It all started when Nvidia came out with its new Series 8 GPU line, announcing that the 8800 graphics card series is ‘Designed for Windows Vista’. This was before windows vista was officially released (Jan-30-07). At that point, the manufacturing partners of Nvidia, such as Asus, EVGA and others, have started producing these cards and selling them with a statement saying ‘Built for Microsoft® Windows Vistaâ„¢’ as part of the product features and capabilities pitch in their advertising.”

“We believe that Nvidia and its manufacturing partners defrauded us,” says the site. “Therefore, we are proactively gathering information from victims around the world who have suffered similar harms, and who we believe have also been defrauded.”

Earlier this month, Microsoft is being sued over its marketing practices. A lawsuit filed on behalf of a PC buyer alleges the company engaged in deceptive practices by letting PC makers promotes computers as “Windows Vista Capable” despite the fact that the machines were not capable of running the “signature” features of Microsoft’s new Windows Vista operating system.

The Nvidia allegation was that the company did not have any drivers available for Windows Vista system at the time of the released. The 8800 card series also appeared not supported on Windows Vista at all when the new operating system was launched. A few days later, drivers were release and “all hell broke loose.”

The site welcomes people to post a complaint relative to the 8800 graphics card series. However, it did not published as to the number of people who have already done so.
